Supreme Court Seeks Middle Ground on Firecrackers

The Supreme Court of India has once again navigated the delicate waters of cultural tradition and public health, delivering a verdict that eschews a blanket ban on firecrackers. Instead, the court favours a more measured approach, allowing the use of environmentally friendlier 'green' firecrackers under stringent conditions.

In its ruling, the court underscored the importance of balancing the vibrant cultural tapestry of India against the pressing concern of air pollution, especially during the festive season of Diwali. It is a decision that acknowledges the significance of religious and cultural festivities while also addressing the undeniable health risks posed by traditional firecrackers.

Justice MM Sundresh, speaking on behalf of the bench, pointed out that a complete ban could potentially dampen the festive spirit, yet unrestricted fireworks would exacerbate pollution levels, impacting not only human health but also the environment at large. The court, therefore, advocated for a time-restricted use of firecrackers, specifically those that comply with safety and environmental standards.

The debate over firecrackers is not new, with previous years witnessing similar discussions and rulings. Last year, the court permitted the sale and use of green firecrackers in Delhi and the National Capital Region, albeit under controlled conditions. This year’s ruling follows a similar path but adds further emphasis on the need to eliminate harmful substances such as barium from firecracker compositions.

The Centre and expert bodies have been tasked with ensuring that any firecrackers available comply with the stipulated guidelines. The ruling is a reminder of the ongoing struggle to harmonise tradition with modern environmental imperatives, a challenge that India continues to grapple with as it seeks to forge a sustainable future.
